Terms and Conditions

This contract is intended to be a simple agreement to set out the terms and conditions for the hire of equipment and services from the Company to the Hirer. This service includes the delivery, set up and collection of the equipment unless otherwise stated in the quote. It does not include the engineering of the equipment or instructions on how to use the equipment unless a sound engineer has been requested and paid for by the Hirer.

Hire period

The hiring period commences at 12:00hrs on the first date of the hire period unless otherwise specified in the order confirmation and hire contract. The hire period terminates at 12:00hrs on the last date of the hire period unless otherwise specified in the order confirmation and hire contract. If access is not possible and delivery is delayed, waiting shall be charged at 20Euro/hr. After waiting for 1 hr the Company has the right to return to base and charge for 1 days rental. If the company is not able to gain access to make collection, the Company has the right to charge an extra day at the same rate as the hire.

Payments

The company requires a 25% deposit payment to secure the booking and the balance at the end of sound check in cash unless agreed otherwise in writing.

The company reserves the right to remove the equipment at the end of sound check if this condition is not met. Cancellation of a booking will result in the loss of the hirer’s deposit. The Hirer shall in no circumstances remove the equipment from Ibiza without obtaining the consent of the Company in writing.

Customers responsibility

For the duration of the hire, the equipment is under the care and control of the hirer, and they agree to take necessary precautions to ensure the safety and well being of the equipment. This will include the cost of the lost/damaged equipment and the loss of earnings whilst it is not replaced. The equipment will be kept clean and tidy and will be cleaned by the hirer if not found to be in the same condition that it was when delivered otherwise a charge will be made of 10euro per item other than cables which will be charged at 2 euro each.

The Hirer will not sell or offer for sale, assign, mortgage, pledge, underlet, lend or otherwise deal with the equipment or any parts thereof in a manner prejudicial to the company's rights, but will keep the equipment in its possession and will not remove the same or any part or parts thereof from the place where the equipment is for the time being and will duly and punctually pay all rents, rates, taxes, charges and impositions payable in respect thereof on demand and will protect the same against distress, execution or seizure and indemnify the Company against all losses, costs, charges, damages and expenses incurred by it by reason or in respect thereof.

The company’s liability in respect of any defect or failure of the apparatus supplied is limited by making good or replacement or repair defects which under proper use and conditions appear therein and arise solely from faulty design materials or workmanship. We are not to be held liable for stoppages or any consequential loss or damage arising out of work done or services rendered under any contract of hire.

Health and safety

High Sound Pressure levels can cause permanent hearing damage. Repeated exposure can have a cumulative effect. Equipment provided by the company can and does produce high enough sound pressure levels to cause hearing damage. The company cannot accept liability for any individual's failure to stay at an appropriate distance from loudspeakers or failure to take any necessary steps to protect their own hearing. It is the responsibility of the Hirer to ensure the safety, with regards to hearing, of the general public. Where appropriate the customer may wish to ensure that warning notices are displayed, hearing protection is issued, or safety barriers are erected.

Insurance:

The Hirer agrees to pay the company the full retail cost of any equipment lost, stolen or damaged beyond economic repair.

If the Hirer decides not to accept or pay for the company’s insurance they must arrange for their own insurance to cover the equipment, and agree that any loss or damage, direct or in-direct, will be repaid to the Company in full

All monies received by the customer from any insurance company or third party in settlement of any claim shall be held in trust by the customer and paid to the company on demand to the extent that any such payment is due under this clause.

Force Majeure:

The Company will not be liable for any failure to supply a product or service where that failure is wholly caused by an event we could not reasonably foresee, forestall or prevent. This may include (but is not limited to) acts of war, terrorism, or natural disasters.
